who we are

About Us

We are an independent Labour Dispute Resolution Agency accredited by the Commission of Conciliation Mediation and Arbitration in terms of section 127 of the Labour Relations Act 66 of 1995, as amended, to conduct conciliations and arbitrations, as well as Inquiries by Arbitrators, as provided for in section 188A of the LRA.

All of our Commissioners are CCMA Part Time Commissioners and accredited accordingly.

The ALDR process

Step 1.

The party referring the dispute is to complete the appropriate referral form and submit it to ALDR by email to ___________.

Step 2.

You will then be provided with a quotation within 24 hours of the referral form being submitted to ALDR.

Step 3.

Upon the payment of the quotation, the date for the enquiry will be allocated, either by agreement between the parties, or by ALDR.

Step 4.

In setting the enquiry down, we will be led by the Labour Relations Act in setting down
conciliations and arbitrations, whereas we will be led by an employer’s Disciplinary Policy in Inquiries by Arbitrators.

Step 5.

The venue for the hearing will either be at the workplace, at another another venue
organised by the parties, or if the parties cannot agree, at a venue arranged by ALDR.

Step 6.

A commissioner will then the appointed by ALDR and will attend to the chosen venue on the allotted date and time.

"If balance struck by the LRA thus recognises not only that managers are not experienced judicial officers, but also that workplace efficiencies should not be unduly impeded by onerous procedural requirements."- Van Niekerk J -

Guide to Labour Dispute Resolution

Labour Dispute Resolution is regulated by the Labour Relations Act 66 of 1995 which is prescriptive as to which mechanisms can be used by commissioners to resolve disputes. In short, there are 3 main mechanisms used by the Act. These are conciliation’s, arbitrations and Inquiries by Arbitrators. Fortunately, we are accredited by the CCMA to resolve disputes using these mechanisms.
